General Rules and Regulations

 

Article 1. Organizing company

The private limited liability company WHITE CINEMA BRUSSELS SRL, abbreviated and hereinafter referred to as “WCB,” having its registered office at 163 Quai des Usines, box 177, 1000 Brussels, with company number 0.640.784.770, represented herein by its permanent representative, Mr Jérôme de Béthune, organizes free contests with no obligation to purchase (hereinafter referred to as the “Contests”).

 

Article 2. General

WCB organizes a series of Contests exclusively through the pages it administers on Facebook and Instagram (hereinafter referred to as the “Page(s)”, “Facebook Page”, or “Instagram Page,” available at the following addresses: https://www.facebook.com/WhiteCinema/ and  https://www.instagram.com/whitecinemabelgium), as well as via the WCB website (hereinafter the “Website”) and possibly via the “White Cinema” mobile application (hereinafter the “Application”) in order to enable participants (hereinafter the “Participant(s)”) to win various prizes (hereinafter the “Prize(s)”).

 

Each Contest is put online for a limited time and is announced by WCB via a publication on the relevant Page, the Website or the Application, as the case may be.

 

The Contests shall be governed exclusively by:

  • These general rules and regulations (hereinafter referred to as the “Rules and Regulations”) which include the rules that are common to the various Contests;

 

  • The particular terms and conditions for each Contest (hereinafter referred to as the “Particular Terms and Conditions”) which shall supplement the Rules, specifying in particular the address of the Page concerned, the start and end dates of the Contest, the procedures for participating in the Contest and designating the winners, and the Prizes awarded.

These Rules and Regulations are posted on the Website at the following address: white-cinema.be/reglement-concours/?lang=en. The Particular Terms and Conditions for each Contest shall be communicated at the time a new Contest is announced.

In the event of any inconsistency between these Rules and Regulations and the Particular Terms and Conditions of a Contest, the latter shall take precedence.

The Contests are not sponsored, subscribed to or organized by Facebook and/or Instagram.

 

 

Article 3. Participation

Any natural person aged 16 (sixteen) or older who is domiciled in Belgium at the time of the Contest may participate in the Contest. WCB and Belga Films Group personnel, members of the operation’s partner companies, as well as their families (i.e. persons domiciled at the same address) are not authorized to participate in the Contest. If one of these criteria is not met, the registration for the Contest may not be validated.

Participation in the Contests by a minor under 16 (sixteen) shall be subject to the prior written consent of a parent or guardian of that person. Accordingly, any minor participating in a Contest shall be deemed to be participating under the authority and with the consent of the parent(s) or guardian(s). WCB reserves the right to request proof of the consent of the parent(s) or guardian(s) and to disqualify the minor automatically from further participation in the Contest in the absence of such authorization. Any false statement or failure to respond to the request for proof shall automatically result in the cancellation of the minor’s participation in the Contest.

We stress the importance for underaged participants to familiarize themselves, along with their parents or legal guardians, with the contents of these Rules and Regulations and the WCB privacy policy (hereinafter referred to as the “Privacy Policy”), including as regards the use of cookies available on the Website.

The Contests shall take place exclusively on the Pages (https://www.facebook.com/WhiteCinema/ and  https://www.instagram.com/whitecinemabelgium/), as well as via the Website and the Application, if any. Any other form of participation shall be excluded.

 

Participation in the Contest shall not be subject to any obligation to purchase.

In order to participate in a contest each Participant must:

  • Have a valid e-mail address;
  • Have an account on the social media concerned;
  • Accept the terms and conditions of use required by the social media of the Page concerned, the most relevant of which are listed below;
  • Have read and accepted these General Rules and Regulations and the Particular Terms and Conditions of each Contest published on the Website (a link to the General Rules and Regulations and Particular Terms and Conditions shall be provided in each Contest announcement);
  • Communicate his or her surname, forename, age, gender, email address, postal address and telephone number in order to register and/or collect the Prizes;

Participation in the Contest shall be valid only if the information required by WCB is complete and correct and the terms and conditions of participation are complied with. Any entries made using incorrect, falsified or forged information shall automatically forfeit any entitlement to any Prize.

 

 

 

3.1. Contests organized on Facebook

Each Contest organized by WCB on Facebook shall be announced via a publication made on the Facebook Page concerned and each announcement shall contain the Terms and Conditions of the Contest in question.

As of said announcement, each Participant is invited to perform a specific action on the Facebook Page, which may consist for instance of answering one or more questions by way of a comment to a WCB publication on the Facebook Page or via a message to be sent to WCB’s Messenger account (instant messaging software built into Facebook).

In accordance with Facebook’s policy regarding promotions on Pages, groups and events, the above action may not lead to the use of personal diaries and friend connections. In other words, participation in the Contests may not require or encourage Participants to:

  • identify a friend;
  • share a link on their own timeline;
  • share a link to a friend’s timeline.

WCB may, however, invite Participants to like its Pages and to share its Contests thereon.

The completed action shall validate the Participant’s entry into the Contest.

By participating in the Contests, the Participant shall acknowledge and agree that the Contests are not sponsored, endorsed or organized by Facebook.

 

3.2. Competitions organized on Instagram

Each Contest organized by WCB on Instagram shall be announced via a publication made on the Instagram Page concerned and each announcement shall contain the Terms and Conditions of the Contest in question.

As of said announcement, each Participant is invited to perform a specific action on the Instagram Page, which may consist for instance of answering one or more questions by way of comment to a publication.

By participating in the Contests, the Participant shall acknowledge and agree that the Contests are not sponsored, endorsed or organized by Instagram.

 

3.3. Contests organized via a form hosted on the Website

Each Contest organized by WCB via a form that can be downloaded from the Website shall be generally announced via a publication on the Facebook and Instagram pages, as well as on the Application. The announcement in question shall contain the hypertext link referring to said form, as well as the Particular Terms and Conditions of the Contest in question.

As of said announcement, each Participant shall return the form in question duly completed as per the announced formalities.

 

Article 4. Designation of the winners

The winners shall be designated by a jury that will select them on the basis of the correct answers given by the Participants to the questionnaire drawn up for the Contest in question. If several Participants have answered the questionnaire correctly, WCB reserves the right to break the tie by means of one or more subsidiary question(s). In the event that participation does not consist of answering such a questionnaire, the winners shall be designated in accordance with the terms and conditions announced in the Particular Terms and Conditions of the Contest in question.

Only entries which have registered within the time limits announced and which comply with the terms and conditions of participation will be taken into account.

The number of winners that may be designated as well as the date of designation, where applicable, shall be specified for each Contest in the Particular Terms and Conditions for each Contest.

 

Article 5. Exclusion from the Contest

Unless specified otherwise in the Particular Terms and Conditions, each Participant may participate only once in a Contest. WCB reserves the right to exclude Participants from the Contest if they do not comply with all of the terms and conditions of these Rules and Regulations, e.g. by participating more than once using different e-mail addresses or identities, and, in general, in the event of deception or fraud. This exclusion shall be automatic and not subject to any prior warning.

Where applicable, WCB also reserves the right to require that a Prize already awarded be returned and to claim damages for any harm suffered (including damage to its image). In such a case, WCB may, at its discretion, decide to select an alternative winner or not to re-award the Prize.

 

Article 6. Prizes and announcement

The Prizes to be awarded and their value shall be specified in the Particular Terms and Conditions for each Contest.

The date of announcement of the winner(s) shall be disclosed when the Competition is announced and in the Particular Terms and Conditions relating thereto. The losers shall not be notified.

The name of the winner(s) shall be announced on the Facebook or Instagram Page concerned, as the case may be. If the contest is conducted by means of a form, the winner shall as a rule be notified privately by phone or e-mail or even by the post. The winner shall be requested to provide his e-mail address via a private message on Facebook or Instagram, if this information has not already been requested, as the case may be.

The winner shall be contacted exclusively via his or her Facebook or Instagram account, e-mail address, by telephone or by post. WCB shall on that occasion apprise the winner of the practical procedure for the collection and use of the Prize. The winner shall have 14 calendar days to collect the Prize from the WCB counters (163 Quai des Usines, 1000 Brussels).  Unless stipulated otherwise, WCB shall not proceed to dispatch Prizes by post.

If, for any reason whatsoever, the winner indicates that he or she is not able to collect the Prize under the conditions and within the time limits indicated, and/or cannot use it during the period of its validity, the Prize shall be considered to have been definitively lost. The winner shall not be entitled to any compensation and WCB reserves the right to award the Prize to an alternate winner.

If no response is forthcoming from the winner within 14 calendar days, WCB may reasonably consider the winner to have forfeited the Prize, which could then be awarded to an alternate winner or not at all, at WCB’s discretion.

The Prizes offered and provided shall be strictly personal and non-transferable. They must be accepted as announced and may not be contested in any way by the winners, nor be redeemed for their countervalue in cash or in kind, or replaced or exchanged for any reason whatsoever, including in the event of loss or theft.

 

Article 7. Liability

 

7.1. Liability for technical services

Participation in the Contests shall entail knowledge and acceptance, by each Participant, of the characteristics and limitations of the Internet, in particular as regards technical services, risk of interruption and risks inherent in any connection and transfer via the Internet, the lack of security of certain data against possible diversion and the risks of hacking and infection by possible viruses.

WCB may not be held liable under any circumstances, in particular but not exclusively, for transmissions via the internet, malfunction of the Internet and/or the software used, the consequences of offences, viruses, bugs, anomalies, technical failures, any defect whatsoever at the technical, hardware or software level, whatever its nature.

WCB may not be held liable either in the event of direct or indirect damage resulting from an interruption, any malfunctions whatsoever, the exclusion of Participants or the termination of the Contest for any reason whatsoever.

The foregoing notwithstanding, as the controller of the personal data of the Participants, WCB shall be required to comply with the obligations imposed by the relevant legislation on personal data protection as set out in Article 8 of these Rules and Regulations and the Privacy Policy posted on the WCB website (https://white-cinema.be/confidentiality-policy/?lang=en).

 


 

7.2. Liability for the conduct of the Contests

WCB shall not be held liable for any change, curtailment or cancellation of the Contests due to force majeure or any other a reason that is unforeseeable, irresistible, or beyond its control. WCB reserves in particular the right to replace the Prizes announced by other Prizes of equivalent nature and value, for any reason whatsoever, without incurring liability as a result.

WCB shall not be held liable for any failures in the postal or electronic messages used with regard to the dispatch of the prizes.

WCB reserves the right in any event to shorten or lengthen the period of the Contest and to postpone any announced date. No printing, spelling, typographical or other errors will be accepted as grounds for any claim for compensation or any obligation on the part of WCB.

WCB shall not be held liable for any damages arising out of the participation in the Contest or the awarding or accepting of the Prize.

In the event of irregularities, such as but not limited to, errors on the Pages, WCB shall decide at its sole discretion on how the problem is to be solved and corrected. WCB’s decision may not be contested. WCB shall not be held liable for the way in which the action is handled.

WCB shall under no circumstances be held liable in case of impersonation or any other act of deception relating to any Participant’s identity.

 

Article 8. Privacy and processing of personal data

 

8.1. General

The personal data that you provide to WCB for the Contests it organizes are processed in accordance with Regulation (EU) n° 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation).

The purpose of this article is to supplement the Privacy Policy (posted on https://white-cinema.be/confidentiality-policy/?lang=en), so it is strongly recommended to consult it in order to have full information on all processing of personal data carried out by – and the obligations of – WCB.

 

8.2. Personal data processed

The information collected by WCB concerning the Participants in the Contests is as follows:

  • surname,
  • forename,
  • gender,
  • e-mail address,
  • postal address,
  • telephone number

These data are provided by each Participant when the requested action is carried out in order to be duly entered in the Competition and/or by the winner(s) when contacted by WCB.

 

8.3. Purposes of the processing and legal basis

These data are collected and processed by WCB exclusively for the following purposes:

  • management of the registration for the Contests published on the Pages;
  • designation of the winners;
  • informing the winner(s) about their prize on the social media;
  • management of the awarding of the Prizes;
  • management of the routing of the Prizes;
  • informing the winner(s) about the procedures for collecting and using the Prizes;
  • management of challenges or claims;
  • management of requests for the data subjects concerning the exercise of their rights to their personal data;
  • control of fraud and abuse and management of eliminations where appropriate;
  • management of the reimbursement of connection and postage costs.

The aforementioned processing is consequently necessary for the legitimate interests pursued by WCB.

Personal data shall be kept for the duration of the Competition in question and for 3 (three) years maximum after the end thereof.

Under no circumstances shall WCB make use of a Participant’s personal data for advertising purposes nor disclose such information to other companies and/or commercial partners, without the prior, free, specific and informed consent of that Participant.

 

8.4. Rights of the data subjects

As a data subject, each Participant shall have the following rights concerning his or her personal data:

  • Right to be informed;
  • Right of access;
  • Right of rectification;
  • Right to object;
  • Right of erasure;
  • Right to limitation of processing;
  • Right to data portability;
  • Rights related to automated decision making, including profiling.

Article 9. Voidability

The voidability or unenforceability of a clause of these Rules and Regulations shall not affect the other clauses. Any voided clause shall be replaced by a clause of equivalent legal and economic nature.

 

Article 10. Waiver

WCB’s failure to lay claim to any provision of these presents shall under no circumstances be misconstrued as a waiver of subsequent claim thereupon.

 

Article 11. Applicable law and competent courts

The relations between WCB and the Participants shall be governed by Belgian law. Any dispute between the WCB and a Participant concerning the existence, interpretation, execution and consequences of the Contests and of these Rules and Regulations shall be referred exclusively to the Brussels French-speaking courts.
