GENERAL TERMS AND CONDITIONS OF SALE

WHITE CINEMA – ONLINE SALES

 

1. Scope of application of the present General Terms and Conditions

The website www.whitecinema.be and the websites which are part of it or are linked directly to it (referred to hereinafter as ‘our Website’ or ‘Website’) are operated by SPRL WCB, whose registered offices are at 1000 Brussels, Quai des usines 163 box 177, company reg. no. 0640.784.770, postal address: 1000 Brussels, Quai des usines 163 box 177 and whose e-mail address is info@whitecinema.be (referred to hereinafter as ‘White Cinéma’, ‘we’ or ‘our’). The present General Terms and Conditions are intended to define the rights and obligations of  White Cinéma and users who buy White Cinéma Products personally via our online shop at our Website (referred to hereinafter as ‘the Customer’, ‘you’ and ‘your’). Purchases for business purposes are governed by general and special terms and conditions for business clients.

Before confirming your payment, please read these General Terms and Conditions and our Confidentiality Policy through carefully. When you buy online for your personal use at our Website, you confirm you accept the present General Terms and Condition and Confidentiality Policy. You cannot buy anything unless you accept these terms and conditions. All transactions between you and White Cinema are governed by the present General Terms and Conditions alone, and no other terms and conditions apply unless we have accepted them in writing.

We reserve the right to vary these General Terms and Conditions at any time. If you place any orders after they are varied, you will be presumed to accept these new terms and conditions. We may add other conditions to these General Terms and Conditions, provided we refer to them expressly: should any conflicts arise, the General Terms and Conditions will prevail.

The present General Terms and Conditions of sale online apply as of 20 October 2016.

2. Products and Product Information

The present General Terms and Conditions apply to cinema tickets (referred to hereinafter as ‘the Tickets’ and/or ‘the Products’) bought via our online shop at our Website.

All our Product Information (prices, programmes, terms and conditions of use, etc.) can be found on our Website and will be found on the confirmation of purchase and admission tickets customers receive as the case may be.

3. Sales process

We offer our services on our Website in French, Dutch and English.

Step 1: Select film

Once on our website, click on ‘Now playing’ to see the full list of films we are currently showing. Select the film you want to see and click on ‘Buy ticket’.

Step 2: Select screening

You will now see a timetable showing when the film you selected is showing and a file which tells you about it. Having made your choice, click on ‘Select screening’ and confirm.

You cannot book more than 10 seats per booking.

Step 3: Select seat

You will now see a seating plan of your screen. Select the seat(s) you want and click straight on them. We will tell you whether the seats you booked are available in real time when validating payment; confirm them by clicking on ‘add to shopping cart’.

A summary of your booking will appear: you can then change your booking ‘Amend booking’ or confirm by pressing ‘proceed to checkout’.

Step 4: What White Cinéma offers

White Cinéma would draw your attention in particular to the special terms and conditions which may apply to each screening and that you need to be fully aware what these are before you book any tickets: so, once you’ve finished booking, do not click on ‘Confirm’ until you have checked what you booked and changed it if necessary.

Step 5: Login

Before you can complete your purchase, we ask you to say who you are. If this is the first time you are buying Tickets on our Website online, you need to register first. We will then send you an e-mail confirming your details, together with a hyperlink you can use to activate your White Cinéma account.

Step 6: Accept our General Terms and Conditions of Sale, Building Rules and Confidentiality Policy

You must have noted these present General Terms and Conditions of Sale, Building Rules and Confidentiality Policy and accepted them unreservedly by clicking on “I’ve read and accepted the general terms and conditions”.

Step 7: Pay and confirm booking

We cannot validate your booking, and it will not be final, until you have paid for it.

We will e-mail you confirmation, including all the details on the form and your acceptance of the offer to the address you gave when you made the booking.

Tickets cannot be returned or exchanged. All bookings are final and cannot be amended or cancelled once confirmation has been sent.

4. Prices and payment

The only ways to pay are those which are offered on the Website, on the terms stated there.

By placing your order, you certify you have capacity in law to conclude this purchase or that you at least have your guardian’s consent to buy these Products for private purposes.

In confirming your payment, you agree to White Cinéma debiting your payment card with the price of all Products purchased and/or booked and the management charges involved.

All purchases must be paid for immediately, and all amounts will be debited to the debit or credit card you used when making your booking.

Only payment in euros (€) is accepted. White Cinéma cannot be held liable for any errors or inaccuracies in the conversion system used or for any difference which may arise between the total estimated value of your order or booking and the amount invoiced.

White Cinéma reserves the right until such time as a purchase or booking is made to vary the price of the Products offered for sale, and we will not offer any reduction in price or make any refund if the price is reduced or if there is a special offer after you buy.

White Cinéma reserves the right to refuse or cancel orders if there is any indication of fraud.

5. Delivery

Unless expressly stated on the Website otherwise, Products will always be delivered electronically, e.g. by sending confirmation of purchase and admission tickets to the e-mail address the Customer gave. Customers are responsible for the e-mail addresses they give being valid, and must verify that the messaging protection software they use to receive Products is working securely. The risk of losing Products sent electronically passes to the Customer at the moment the e-mail is delivered to the Customer’s provider.

 

We always send Customers an e-mail confirming what they bought and summarising the main details. It is up to the Customer to keep this e-mail. If you don’t get an e-mail confirming you bought the Products you ordered, you can contact White Cinéma at info@whitecinema.be .

 

The confirmation of purchasing the Tickets includes an admission voucher or link to that voucher.

White Cinéma reserves the right when checking admissions to screens to demand official proof of identity and/or entitlement to reduced rate which identifies you and/or to verify you are entitled to the reduced rate applied.

Admission vouchers, whether printed or displayed on a smartphone entitle you to receive the Tickets at the entrance booths of the White Cinéma Brussels. If you don’t have a printer or smartphone, you can use the booking code shown on the confirmation of purchase and admission voucher and print your Tickets at the automatic tills at the cinema complex.

White Cinéma cannot accept any liability if tickets are used unlawfully.

 

 

6. Right of retraction

You cannot cancel purchases once you have made them.

Once a Customer has bought Tickets and hence reserved seats for a specific cinema screening or a special event, they cannot cancel them.

Tickets cannot be exchanged or refunded; they are also personal and non-transferable and are valid only for the place, screening, date and time stated on them, and not otherwise.

We cannot guarantee that you will be able to enter a screen once the screening time has started, and you will not be entitled to a refund. We therefore advise you take the seat shown on your ticket at least 15 minutes before the screening is due to start.

7. Liability

White Cinéma guarantees that the Products will have the characteristics which were stated on the Website. When you buy Tickets, the Website will indicate whether seats are available for the screening you choose in real time. White Cinéma does not guarantee the film schedule will remain unchanged for any given period.

 

Should any IT problems arise such that the Customer does not receive the product(s) they bought at the e-mail address they gave, White Cinéma will refund Products purchased within 30 days

 

White Cinéma’s liability is limited to the value of the Products purchased in any case.

 

The Customer will however be liable for any mistakes made during the purchasing process such as giving an incorrect e-mail address or stating the wrong Products or Product characteristics, such as the film chosen, place of screening, time of screening or seats booked. The Customer will also be liable for how Products are used, such as if Products are lost, are not used while valid, allowing others to use the Products without the Customer’s consent and for any unlawful use of the Products.

 

8. Personal data

White Cinéma respects your privacy, and will do everything necessary to protect your rights here in the course of your using our site.

 

To process and execute sales, White Cinéma needs some personal data: we will then tell you clearly what kind of details we need to give you the service you want. White Cinéma warrants we will use the data we gather when you make your purchase in accordance with our Confidentiality Policy on privacy which Customers can see on our website, and which forms an integral part of any and all agreements we make with them.

 

White Cinéma is responsible for processing personal data gathered via our Website and may delegate processing that data to a subcontractor.

 

We will not send data to any third parties, however.

 

Under the law of 8 December 1992 on protecting privacy when processing personal data, you have the right to access and correct the information about you which you can do simply by demanding in writing accordingly by sending us an e-mail at info@whitecinema.be together with a copy of your identity card.

You can also refuse to allow data on you to be processed if you have legitimate reasons to do so; but then you will be unable to access certain functionalities on our site.

9. Website security

Our Website is protected by state of the art security systems and uses SSL (Secure Socket Layer) encryption. Our Website never has access to confidential information on the means of payment used: in fact, Concardis alone has this confidential information (card no., expiry date, etc.) which are rendered inaccessible to third parties.

  1. General restrictions on Website and intellectual property rights By using our services, you agree not to:

˗     Modify and/or amend the Website preventing or restricting any party from using it, wholly or in part;

˗     Use the Website content for anything other than personal non-commercial use as provided and authorised by the normal and usual functionalities of the service concerned;

˗     Copy, reproduce, distribute, transmit, broadcast, display, sell, grant any licence to or use the Website and service content for any other purpose, wholly or in part.

Anyone who fails to comply with any of these conditions is in breach of the present general terms and conditions and renders themselves liable accordingly.

White Cinéma also reserves the right to develop, modify or suspend Website content and access to it for maintenance purposes or for any other reasons without notice. No indemnity will be due should the Website be inaccessible as a result.

Information published on the Website, including the present General Terms and Conditions, is the property of White Cinéma or of third parties who have authorised White Cinéma to publish that information on its Website.

The Website is an original creation, the content and structure of all elements of which are protected by copyright and other intellectual property rights, concerning in particular the paging, structure, databases, source code and software. This also applies to illustrations, text, photographs, logos, drawings, images, sound and other audiovisual materials used.

All commercial trademarks used, registered trademarks and company names are commercial trademarks or registered trademarks which are the property of the holders concerned.

Users can never acquire any rights to any elements of our Website: so they may not copy, adapt, translate, edit or modify it or distribute, sell, publish or market the Website, wholly or in part, particularly by creating links to the Website or recording information in a database in any form and in any way whatsoever, whether electronic, mechanical or otherwise.

Any infringement of intellectual property rights may be prosecuted in civil and criminal law.

White Cinéma acquires intellectual property rights as described above to information anyone who uses the Website puts online. By putting information online, such as text, illustrations or other files, you yield your intellectual property rights to them to White Cinéma insofar as the law allows and authorise White Cinéma to use, distribute and/or modify this information on the Website and elsewhere for free.

11. Governing law and disputes

Belgian law alone applies, to the exclusion of the United Nations (Vienna) Convention on Contracts for the International Sale of Goods (CISG). All disputes as to the conclusion, validity, interpretation and/or execution of the contract and/or the present General Terms and Conditions will be subject to the exclusive jurisdiction of the Belgian courts. Should any of the current terms and conditions be null and void or avoided, the remaining conditions will remain entirely in force.
